Land Use

McDonough Holland & Allen's land use attorneys have represented both public entities and private property owners and developers throughout California, Nevada, Idaho and Oregon in a comprehensive range of land use issues. One attorney in the group is general counsel for the California Redevelopment Association, and is active in drafting legislation and representing individual redevelopment agencies before the State Legislature. In addition, members are experienced trial and appellate attorneys in all aspects of land use issues.

Our land use attorneys also work extensively on land use matters involving negotiation of development agreements for a wide variety of undertakings, from single facilities to complex mixed-use projects. Sample development projects have included:

  • Yerba Buena Gardens in San Francisco, a public-private financed mixed-use project containing a retail pavilion, hotel and office space;
  • the San Jose Silicon Valley Financial Center, containing hotel, retail, office and residential buildings; and
  • Marin City U.S.A., which combined retail space, market rate and affordable housing units, reconstruction of a freeway interchange and various public facilities.

We are active in organizations such as the California Redevelopment Association, American Planning Association, the Urban Land Institute, the International Council of Shopping Centers, the American Bar Association Committee on Land Use and the National Association of Housing and Redevelopment Officials. Our attorneys frequently serve as speakers, instructors and visiting professors at national and state seminars, conferences and institutions, and several members of the redevelopment group have co-authored Redevelopment in California, a comprehensive guide to redevelopment law covering the latest developments in statutory and case law.
