Professional Experience

Mary is a member of the firm’s Real Estate practice group. She specializes in problems arising out of insolvency and monetary defaults, including representation of creditors in bankruptcy cases, enforcement of secured creditors’ rights, construction-related payment remedies, commercial lessor’s rights upon tenant’s defaults and structuring transactions to ameliorate insolvency risks.

Mary has more than 22 years’ experience in the insolvency and creditors’ rights area, and has been practicing with McDonough Holland & Allen PC since 1986. She is a frequent speaker on bankruptcy and other solvency issues, including the interaction of bankruptcy and construction law.

Representative Matters

Represented buyer in acquisition of more than $5 million in real estate assets from bankruptcy estate

Represented surety in enforcing subrogation rights to $5 million in construction contract proceeds due on bankrupt contractor’s projects

Defended supplier on construction contract against preference claim by bankruptcy trustee

Defended, at trial and on appeal, purchaser of real property against claim by bankruptcy trustee that automatic stay voided transfer of title to purchaser

Represented title insurance company in enforcing indemnity claim against former property owner

Advised public agency on public work bonding requirements and structuring transaction to minimize risk of counter-party’s nonpayment

Represented construction contractors in enforcing mechanic’s lien claims against bankrupt project owner

Represented two municipal utilities in terminating power purchase contracts with Enron during Enron’s bankruptcy

Represented municipal utility in enforcing $1 million claim in PG&E’s bankruptcy

Represented surety in enforcing $1 million subrogation claim against bankrupt contractor and competing claim by bank
